Congressman Derrick Van Orden from Wisconsin's 3rd District has put forward a resolution for the impeachment of Judge Paul Engelmayer of the U.S. District Court for the Southern District of New York. The resolution follows Judge Engelmayer's decision to halt an executive order by former President Donald Trump, which aimed to establish and implement the Department of Government Efficiency.
Van Orden expressed his concerns about judicial overreach, stating, "Judges are meant to interpret the law, not write it." He emphasized that there are three coequal branches of government and criticized what he sees as "legislating from the bench" by judges. According to Van Orden, Judge Engelmayer's actions have exceeded his judicial authority and represent a challenge to both the Constitution and those who supported Trump's presidency.
The impeachment resolution was submitted on February 18, 2025, and referred to the Committee on the Judiciary. It accuses Judge Engelmayer of high crimes and misdemeanors through two articles: Judicial Misconduct and Abuse of Judicial Authority, and Abuse of Judicial Power.
The first article claims that Judge Engelmayer showed bias against Trump by halting his executive order on political grounds. It alleges that this action demonstrated prejudice against Trump supporters and disregarded legal precedent.
The second article accuses Judge Engelmayer of using his position for personal or political interests rather than applying the law impartially. It suggests that his handling of this case undermined justice principles.
Van Orden believes these actions warrant removal from office for high crimes and misdemeanors.
